Ayatollah Beheshti made a significant contribution to the drafting of the Constitution of the Islamic Republic of Iran. The purpose of this article is to examine the position of the Constitution in Ayatollah Beheshti›s legal thought. By applying the analytical-historical method and emphasizing the position of general and fundamental rights in his thought, the authors try to show how he, using Quranic and narrational sources and political experiences, incorporated legal concepts into the chapters of the Constitution of the Islamic Republic of Iran. The main question of the research is expressed as follows: why did Ayatollah Beheshti go for such an idea of establishing a political legal system and why did he accept the Constitution?
The findings indicate that her unique intellectual system in the field of fundamental rights includes the specific characteristics of the constitution in her view, leadership and the people in the constitution, political sovereignty, supervision in the constitution, political development, economics in the constitution, Islamic economics, and economic justice.(feminine) It is also the specific approach of this Islamic thinker to the «imamate-ummah» system and, of course, the legitimate freedoms in the constitution that distinguish his view of the concept of the constitution from others.
